Description All persons registered in the business register are considered entrepreneurs according to the Civil Code. In this article, I argue that contracts concluded by these so-called formal entrepreneurs with natural persons acting outside their business or profession should not be qualified as consumer contracts automatically, but only if the formal entrepreneurs also fulfil the material characteristics of an entrepreneur.
