Description When assessing foreseeability in tort law, for simplicity, we usually personify its criteria and ask whether a given circumstance was foreseeable to a particular actor or to an average person, to a proper expert or to a so-called optimal observer, etc. The criterion of foreseeability is used in determining both wrongfulness and fault, which leads to the question of whether and how these aspects differ and whether it makes sense to distinguish between them at all in tort law.
