Description This article presents the argument that extended confiscation is not a punishment nor a protective measure and should be regulated separately. By inappropriately including extended confiscation among protective measures, the legislator created a situation in which this sanction can be imposed also in connection with crimes committed before the amendment of the criminal law came into effect (retroactivity of the sanction), its enforcement is not time-barred and it is possible to impose it even outside the main trial, with any time interval from the conviction, which is supposed to be its basis.
