| Description | An agreement on guilt and punishment may also be concluded with the public prosecutor by legal entities that are accused in criminal proceedings. The presentation clearly shows which conditions are necessary for concluding an agreement on guilt and punishment and when in practice it happens that they are not respected by the law enforcement authorities. An agreement on guilt and punishment must not be a means of violating the presumption of innocence or the prohibition of self-incrimination. The presentation concludes with examples of good and wrong decision-making practice. |
