| Description | The topic of this article is the clarification of two ambiguities in Article 8 bis of the Rome Statute of the International Criminal Court concerning the crime of aggression. The first ambiguity addressed in the article is the interpretation of the concept of "manifest violation of the Charter of the United Nations". The author works with three possible interpretations of this concept. He indicates which one he believes to be the most appropriate and which one he believes will prevail in practice. The second ambiguity addressed in the article is whether Article 8 bis, paragraph 2, should be interpreted as demonstrative or exhaustive. |
