Description | The article deals with the use of fully automated systems in the creation of justifications for court decisions in civil proceedings. It discusses technological developments in the field of artificial intelligence and its application in the legal sector, particularly in the judiciary. It describes two types of automated systems: judicial assistant systems and fully automated decision-making systems. The main problem with these systems is the so-called "black box," where it is not clear how the system arrived at its outcome. This paper focuses on the possibilities of solving this problem using explainable AI (xAI). It also addresses the question of which types of court proceedings could benefit from fully automated systems, and under which conditions. It concludes by suggesting that full automation of some court proceedings could reduce the length of proceedings and allow judges to focus on more complex cases. |
