| Description | The contribution deals with the issue of new addictive substances and the possibilities of protecting society using criminal and misdemeanor law. The author wants to draw attention to the pitfalls that criminal and misdemeanor law must face, as new addictive substances are often not inferior to those that are already regulated, as their content or composition is not the same, and therefore the possibilities of their restriction or prohibition in society are minimal, while in relation to young people, however, they face high popularity, and therefore the need to respond to this situation is high. Rather than arriving at concrete proposals de lege ferenda, the author wants to outline problematic areas and suggest possible procedures that criminal law or tort law could take.
