| Description | This monograph deals with the right of a child with an ordered constitutional or imposed protective upbringing to contact with parents and other persons. The right of a child to contact with a parent is one of the fundamental human rights. According to the settled case-law of the ECtHR, the right of parents and children to be together is an essential element of family life. In order for national measures that prevent them from doing so not to constitute an unlawful interference with the rights guaranteed by Article 8 of the Convention, they must meet the conditions set out in Article 8(2) of the Convention. |
