| Description | This contribution explains first of all key words and than analysis, selective, the main problems considering to the general and special part of Czech penal code (de lege lata and de lege ferenda). Text follows concrete consequences of the differentiation between the negativ error of law concerning of normative and descriptive element of body of the crime, resp. of out-of-penal nonclaimed element and out-of-penal claimed element, for criminal responsibility. It contents some recomendations to the solution of this problems. It offers some comparison with foreign countries too and one look from point of view of european law. |
