| Description | This paper deals with the problem of arbitration clauses (not only) in consumer contrasts and possible human rights consideration. Considerations especially from the point of view of the right to a fair trial, fair hearing. The main and in legal literature still unresolved question is if human rights guarantees should be applied to arbitration, voluntary or obligatory arbitration. In my work I will discuss among others the possible application of Article 6 Paragraph 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms, with subsequent additional protocols, to arbitration proceedings. |
