| Description | This article argues that the existing legal construction of a foreigner is in Czech law based on the unsatisfactory conceptual framework "nation-state-citizen". This framework affects a discriminatory form of the asylum in the Czech republic. The protection of human right is strong formalized by this framework. The article provides a critical reconstruction of this framework and shows its possible evolution as a thinking model. The article reflects the critical reconstruction of this framework by J. Habermas and G. Agamben. |
