| Description | The judgment of the Austrian Constitutional Court issued on 11. 10. 2001 became one of the supporting arguments in the judgment of the Czech Constitutional Court in the so-called Melčák case. It was than indicated that the Austrian Constitutional Court had repealed the constitutional legal act due it was in the breach of the material core of constitution. This paper, however, dealing with the quoted Austrian Constitutional Court decision comes to the conclusion that that reference was not just appropriate. |
