| Description | The contributions brings a reflection on rather different approaches to the review of the disretionary power in a concrete decision of the English court from the 16th century (Rooke s case) and a one from the contemporary Czech court, which are based on similar facts and similar ways of solution, but quite different in the reasoning, even though the more adequate and profound in legal arguments seems to be the historical one, and it can serve as an inspiration for contemporary decision-making. |
