| Description | The authors deal with the issue how the paternity determination by the common declaration of parents can be abused. It is not a hypothetical problem, which the authors demonstrate at the examples from Germany. While deliberating a possibilities how to solve this problem, the authors analyze the current practice of applying § 62 of the Act on Family by the supreme prosecutor of the Czech Republic. The authors point out that there are some insufficiencies in the regulation of the disavowal of paternity ex officio. Also the citizenship consequences are mentioned, especially the issue whether or not the citizenship can terminate by the disavowal of paternity. |
