Description | The second half of the 20th century brings a new challenge to traditional concept of penal law. Someone talks about the „crisis of punishment paradigm", in connection with high recidivism rate, overcrowded corrective facilities, overloaded criminal justice system and lack of the attention to the victim of crime. Diversions, in term of the positive alternative to material decriminalization, represent a new type of state reaction on crimes that diminish stigmatization and improve the position of the victim. On the other hand, there is a danger of the devaluation of basic principles of penal law (ultima ratio principle). Would it be a true penal law, if the punishment lose its crucial position and becomes one among many types of sanctions? |
