Description This contribution explains the basic concepts and analysis the main problems considering, first of all to the general and special part of Czech Penal Code (No 140/1961 and No 40/2009). Text follows concrete impacts of the principle of forbidding of the retroactivity penal codes in malam partem, a contrario: of order of the retroactivity penal codes in bonam partem, in context with forms of errors of the perpetrator – factual and legal error, negative, positive, legal error concerning of normative element of body of the crime, resp. concerning of out-of-penal nonclaimed element, and out-of-penal claimed element, as well as error about of circumstances excluding illegality (culpability) of act. It contents some recomendations to the solution of this problems.
