Description | The article deals with judgement of the Constitutional Court No. III. US 205/11 of 7. 6. 2011, which annuled decision of the High Court in Prague No. 5 Cmo 364/2010 of 21. 10. 2010. The Constitutional Court stated in the aforesaid judgement that the principle of equality of parties to proceedings and of equality of arms as stipulated by art. 36 par. 3 of the Charter of Fundamental Rights and Freedoms and art. 6 par. 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms shall apply also in the proceedings on preliminary injuction. |
