| Description | Under the traditional legal doctrine, employees of corporations violating the environmetal statutes can be prosecuted criminally but corporations, on whose behalves they violate, cannot. In the Czech Republic, this approach has been changed recently by adoption of the Act No. 418/2011 Coll.on the criminal liability of legal persons. This contribution is focused on the question of necessity to introduce the criminal liability of legal persons to the existing liability system in the Czech environmental law and on possible advantages and shortcommings of this legislative change. |
