Judge’s dignity as a reconstructive element of justice

| Popis | Judges are generally considered as group of persons that uphold a high level of dignity. Even though various legislation and many ethical codes use this term, there are very few attempts of its definition. This paper shows that the dignity of a judge can be a fluid concept and we do know very little about the content of its core and penumbra. That alone can be disturbing, but this paper argues that through trying to understand this term and its consequences within the legal system, we can better understand the system, its flaws and, consequently, try to help it more efficiently. This paper focuses on the concept of judicial dignity in the theoretical sense and provides an empirical evidence of disciplinary proceedings with Czech judges where the threat to trust to judiciary and violation of judge’s dignity played a crucial role. It also provides a brief introduction to Czech legislative background of disciplinary proceedings. On these bases the paper presents several categories concerning judge’s dignity and its elemental aspects, as well as problems that can arise from the legislative setting of disciplinary proceedings. Czech examples can provide useful reflections because they can show experience with various versions of disciplinary proceedings. Thus, the paper can provide empirically supported discussion which model can support the justice system with more restorative power in the context of several countries in central Europe. |
