Popis | This contribution discusses the significance of mutual consent among all contracting parties as a critical element for defining offences involving prohibited agreements under Section 3(1) of the Competition Act. It further emphasizes that administrative authorities must clearly specify each individual act of continuing offences in their judgements, including details about the approximate time and manner of infringement, thereby demonstrating mutual consent and confirming the existence and execution of cartel agreements. The same requirement applies to offences described in Section 22a(1)(b) of the Competition Act. |
