| Description | When the expected result of the judicial proceedings seems to be negative, the plaintiffs in some cases apply for a procedural succession right, which could be a target of a legal misuse. The aim of the legal misuse of the analysed legal institute is to avoid the duty of the unsuccessful litigant of the trial to pay the reimbursement of the costs to the winning party. This paper examines the possibilities how to prevent this kind of misconduct. |
