| Description | The article examines the new legal regulation of “compensation” as one of the instruments of termination of obligation. The author analyses the prerequisites of compensation and their system. Detailed analysis is focused mainly on the requirement articulated in § 1987/2 of the civil code, which demands the claim to be “sure and certain”. The legal provision is relatively vague is this regard and it is a new and unknown part of the regulation. The author aims to offer some comments and remarks concerning the proper interpretation of this provision. |
