| Description | The paper deals with the legislation on crimes related to magic and divination in the Roman law from the beginnings until the 5th c. A.D. On the one hand, we can observe that there is a continuity in punishing the nocent magic throughout the period under examination, while, on the other hand, an increasing tendency towards restricting activities connected to fortune-telling, which, beginning with the birth of the Principate, converge with the political crime of lese-majeste, can be noticed. An analysis of legal measures originating in the Principate and the Dominate demonstrates that until Theodosius I. persecution of divination is more linked to politics than religion. |
