Description As the title indicates, the subject of the article is an essay on the feasibility of imposing a fee on access to patient’s medical records within contemporary legislature. The author responds to the practice of healthcare providers with regards to providing access to medical records and deals with the compliance of their practice with the law in force. The author focuses mainly on the issue of the absence of statutory power to charge fees for the access to medical records, especially in comparison with similar domestic legal institutes. Furthermore, the author deals with other possibilities of charging fees for access to the medical records, namely the regulatory fee and the possibility of a contract between the patient and the healthcare provider for the payment of such a fee. At the end the author describes the types of liability that arises for the healthcare providers when charging a fee for the access to medical records.
