Description The book deals with the legal aspects of blanket retention of traffic and location data, i.e. data retention on two levels: the obligation of the operators to retain such data and the authorisation of the law enforcement agencies to request such data. The general part focuses on the basic concepts and definitions, the importance of metadata about communication and its protection by law especially in the context of the fundamental human right to privacy. Furthermore a historical overview of the development of the data retention idea in the European law and the related critique that accompanied this paradigm shift in dealing with traffic and localization data are presented. Further a critical analysis of the Directive 2006/24/EC both from content and human rights point of view is undertaken with regards to the case law of national courts dealing with the constitutionality of the national data retention legislation. In the special part of the work two national implementations of the Directive (Czech and Austrian) are discussed in detail on both above mentioned levels. The last part focuses on the proceedings before the Court of Justice of the European Union regarding the proportionality of the Directive.
