| Description | New legal regulation of maintenance duty and right of maintenance introduced into the New Civil Code is traditional, without many novelties. However, society faces a lot of negative phenomena, for instance unemployment, insolvency, poverty, social exclusion on one hand, and misusing of right to maintenance, unrecor ded work, concealment of incomes etc. We have to consider how to motivate the obliged in substantive and procedural sphere, and h ow to sanction the obliged for non fulfilling the legal duties; regard ing the creditor, we should discuss the question of limitation of the am ount of maintenance. |
