| Description | In his contribution the author examines the aspects of natural law in the new Czech Civil Code. According to the technical report, iusnaturalism should be a philosophical foundation of the code and nature rights and various expressions derived from them have become components of some of its sections. The author primarily asks questions as: Is the choice of this foundation good? Is its realisation correct (especially with regard to competitive concepts as human and fundamental rights)? Do mentioned sections have some real influence on the interpretation of law or only symbolic character? |
