Description | The article is dedicated to objective reasons justifying the renewal of fixed-term contracts or fixed-term employment relationships between the same employer and the same worker. Such reasons are one of the measures adopted with the purpose to prevent abuse of successive fixed-term employment contracts or fixed-term employment relationships according to clause 5 (1) (a) of the Framework Agreement on Fixed-term Work concluded by ETUC, UNICE and CEEP. Other measures that can be adopted to prevent abuse of successive fixed term employment contracts and employment relationships include the maximum total duration of such contracts or relationships and the number of their renewals. The article analyses the objective reasons justifying the renewal of fixed- term contracts or fixed-term employment relationships according to the case-law of the European Court of Justice. Implementation of EU law concerning protection of employees against abuses of successive fixed-term employment relationship in the Czech law is dealt with as well. |
