Description | The principles of legality and opportunity in criminal proceedings are associated with the subject of public prosecutor and his initiatory function in criminal proceedings. Within the criminal procedures led by the principle of legality, public prosecutor is obliged to prosecute all the crimes he is aware of, whereas in the criminal procedural regulations led by the principle of opportunity, public prosecutor with regard to his discretion, however, does not have to conduct the prosecution in such cases. By this contribution, the author would like to provide a historical insight into application of these principles in the Czech and Slovak criminal proceedings since the days of Austro-Hungarian Empire, through the unified regulation in times of common state, until the present form and development tendencies of an examined criminal law issue within the individual legal regulations. |
