Description | Domestic constitutional courts are regularly depicted as the ECtHR’s allies who greatly contribute to the implementation of the Strasburg Court’s judgments and to its effectiveness. A closer look at the mechanisms of implementation of the ECtHR judgments however shows that there are important developments which imply a necessity to specify the position of constitutional courts in the implementation mechanisms. This paper acknowledges the complex nature of implementation mechanisms and draws up a typology of roles that constitutional courts play within the domestic mechanisms of implementation of ECtHR case law. |
