Description | This paper focuses on penetration of the statutory regulation of conflict of interests to the electoral law and electoral legislation. This paper deals with the question if the regulation of incompatibility of functions as well as other restrictions aimed at deputies, senators and members of municipal and regional councils enables to apply the regulation of conflict of interests to an obligatory consent of the Senate. This paper assumes that an electoral law is every law regulating elections regardless of how it is called. This article refuses the idea that the name of the statute should be decisive; according to the author the content of the statute is crucial. The fact that the consent of the Senate according to the Art. 40 of the Constitution is required must be clear since the beginning; it should not be an outcome of a chance. |
