Description | A long-prepared recodification of criminal procedural law proclaims strengthening of discretionary competences of a public prosecutor in criminal (mainly preliminary) proceedings. More discretion in hands of a public prosecutor should be, however, accompanied also with adequate control mechanisms as a safeguard against his arbitrariness. Submitted contribution would like to deal with this topic while it focuses on contemporary possibilities of unjust discretionary decisions of public prosecutor that can be made in preliminary proceedings, as well as some related recodification proposals. After this analysis, the authors, using the historic and comparative method, introduce their attitude to this issue with their eventual suggestions de lege ferenda. |
