| Description | In the paper, author deals with adhesive proceeding, damage (whether damages, or element of body of crime) and mainly injured party in the scope of penal protection of copyright, related rights and database rights. Main focus is on situation of collective manager as injured party in adhesive proceeding, namely from the perspective of current legal regulation and also future legal regulation, which going to be affected by amendment to the copyright act (at the present after 3rd reading in the House of commons), which also implements directive 2014/26/EU of the European Parliament and of the Council of 26 February 2014 on collective management of copyright and related rights and multi-territorial licensing of rights in musical works for online use in the internal market. The amendment extends and refines present shape of collective managers, e.g. establishes independent collective manager, it can be assumed that, the amendment would impact also the criminal proceeding. |
