| Description | The article presents the following opinion: The assignee that enforces the assigned claim from the debtor in the court proceeding has to prove that he has the title to the right that is being enforced. For that purpose, the fact whether or not the debtor was notified of the claim assignment by the assignor is irrelevant. The article criticises the judiciary practice that arrived at opposite conclusions. |
