| Description | Interpretation of principle of subsidiarity of criminal repression embodied in Section 12 par. 2 of Act no. 40/2009 Coll., Criminal Code, has "traditiotally" relied on the opinion of Criminal Division of the Supreme Court from 30. 1. 2013, file no. Tpjn 301/2012, in practice of the Czech law enforcement authorities. Almost five years after its publication, it is appropriate to ask a question if this opinion has contributed to unification of application of this principle. The author of submitted contribution will try to answear this question while focusing on related practice of the criminal courts and public prosecution as well as recent practice of the Constitutional Court. |
