| Description | This paper deals with the relation between license acquisition and a fraud. The author points out that there is a difference between a private license which is established by an agreement and entitles the license holder to obtain a reward and a public license by which a state body grants an authorization to a specific activity. Public license acquisition as an administrative decision does not automatically entitle a subject to obtain a reward. However, enrichment as well as causing damage to another are elements of a fraud. Due to these facts, commission of a fraud is only possible by a fraudulent acquisition of a private license, not by a public license acquisition. |
