| Description | The article deals with the question of what effect does Act No. 185/2016 Coll. have on pre-existing claims to transfer of surrogate land, that are based on the Act No. 229/1991 Coll. It reaches the conclusion that only such interpretation of the Act No. 185/2016 Sb. can be considered in conformity with the Constitution, which rules out the limitation of the claims of the entitled persons without offering adequate (that is corresponding to the market value of the confiscated property) compensation. |
