Description | Th is article analyses recent development in EU environmental law with particular interest in case law of the Court of Justice (CJEU). A brief commentary is provided on recent cases concerning public participation (C-664/15), conservation of natural habitats and of wild fauna and fl ora (C-281/16) and the concept of ‘personal benefi t’ corresponding to the interest in bringing proceedings (C268/16 P). Furthermore, disputes between Poland and EU institutions in the fi eld of air quality regulation are analysed as the Czech government contemplates supporting Poland before the CJEU. Th e article also provides a summary of the glyphosate case in which the Commission fi nally decided to reauthorize the pesticide, ending a bitterly fought battle that saw 1.3 million people sign a petition calling for a ban and the European Parliament openly criticise the Commission’s proposal, saying it fails to ensure a high level of protection of both human and animal health and the environment and fails to apply the precautionary principle. |
