Description Th is article provides analysis of the judgment on compensation of the International Court of Justice in the dispute between Costa Rica and Nicaragua [Certain Activities carried out by Nicaragua in the Border Area (Costa Rica v. Nicaragua)]. It was the fi rst case ever in which the Court was called upon to pronounce on reparations for environmental damages. In determining the compensation due for environmental damage, the Court assessed the value to be assigned to the restoration of the damaged environment as well as to the impairment or loss of environmental goods and services prior to recovery. Th e author expresses disagreement on both the reasoning of the Court and the quantum of damages awarded, mainly due to lack of considerations of equity, non-pecuniary reparations and specifi c international value of the nature concerned. Furthermore, a brief commentary is provided on recent case law of the Court of Justice of the European Union on Polish air quality plans (C-336/16) and defi ciencies in waste water management in Greece (C-328/16), environmental impact assessment (C-117/17, C-671/16) and emission allowance trading (C-58/17, C-572/16, C-577/16).
