Description | Relevant pay-for-delay agreements for competition law are primarily those entered into by pharmaceutical companies as settlement agreements in the context of patent litigations. Competition authorities consider the agreements as anticompetitive by object. Such an understanding of the agreements is however disputable. Couple of CJEU's decisions expected in near future may change this view. |
