Description | This article provides commentary on the recent case law of the European Court of Human Rights concerning environmental limitations to property rights under Protocol 1 Art.1 of the European Convention on Human Rights: judgments in cases G. I. E. M. S. R. L. and Others v. Italy (applications nos. 1828/06, 4163/07, 19029/11), McCARTHY MUSSEL DEVELOPMENT LTD v. Ireland (no. 44460/16), Sharxhi and Others v. Albania (no. 10613/16), Tumeliai v. Lithuania (no. 25545/14), Kristiana Ltd. V. Lithuania (no. 36184/13) and Beinarovič and Others v. Lithuania (nos. 70520/10, 21920/10, 41876/11). The authors further analyse the case law of the Court of Justice of the European Union concerning application of Article 17 of the EU Charter of Fundamental Rights in environmental matters. In addition, the article describes the terminology used by both European courts in relation to the legal concepts of general and public interest. |
