| Description | It has been almost a year that the CJEU decided on the preliminary question regarding the nature of the uberPOP service. The CJEU said it is a part of a complex service in the area of transport. Application of principles stated in the decision significantly affects the nature of business of such platforms. Uber has been obligated (depending on national law) more or less to comply with regulation in the field of transport. Extensive interpretation of the CJEU's decision may threaten innovations on digital markets. The authore expains why such an extensive interpretation shall be avoided and the decision itself should be understood as an exception. |
