Description | Private international law represents the legal discipline whose purposes could be achieved by multilateral international conventions most easily. Other solutions are able to solve particular questions but carry a lot of complications. EC legal regulation solved many of problematic issues as the competence of courts, foreseeability of the law applicable and judgment enforcement. Nevertheless it has introduced new problems towards the extraterritorial impacts and protection of certain values. The conflicts between EC regulation and bilateral agreements belong to them. Solution of this issue must be looked for in the principles of public international law and, without any doubts, there will be discussions about existence, negotiations and content of bilateral agreements. Concerning evaluation of their possible content we could presume that many issues may not be governed by them. |
