Description This article analyses recent case law of the Court of Justice (CJEU) on a strategic environmental assessment (SEA) procedure with a focus on the defi nition of ‘plans and which are likely to have signifi cant environmental eff ects within the meaning of the SEA Directive. A brief commentary is provided on cases concerning two specifi c plans: a regional town planning regulations relating to the European Quarter in Brussels (C-671/16) and a Belgian ministerial order for an urban land consolidation area (C-160/17), and also case law of the CJEU which allows national courts, under certain conditions, provisionally to maintain the eff ects of measures which were adopted in breach of the SEA Directive. Furthermore, interpretation of Art. 6 of the SEA Directive provided by the CJEU and advocate generals is analysed, with a particular interest in the requirement to designate, for consultation purposes, an authority likely to be concerned by the environmental eff ects of implementing plans and programmes (C-474/10, C-379/15).
