Description | This lecture analyses the development of regulation of online platforms in Czech republic, the goals of this regulation and the methods for reaching them. Two options for approach towards the regulation are presented. One is the sectorial approach, where the regulator adjusts the sectorial regulation in the area where given platform provides its services. The other is a general approach trying to regulate online platforms as such. The un/suitability of the two options is examined on two use cases. The first use case presented is the regulation of the Uberpop service, that is already in place. The approach taken was the amendment of the existing regulation of taxi services, specifically of the Act no. 111/1994 Coll., the Road Transport Act. The second use case is the debated regulation concerning accomodation services provided by Airbnb. These two examples serve for deeper exploration of the issues related to regulation of online platforms. The goal of this lecture is to answer the question: "Where is the boundary between consumer's wishes and the effective protection of his rights." In conclusion, possible future development is discussed. |
