Description Public administration in the Czech Republic is a system that is to be defined in a functional sense as the activity of the state, which is performed through bodies derived from state power, ie state administration bodies. The public administration should act in such a way as to be beneficial to society and its activity should primarily be directed at society as such. Certain supervisory and control systems are required for public administration to function. One of these control systems is the interest and activities of citizens who can inquire about the activities of public administration thanks to the Act on Free Access to Information. The paper will deal with this fundamental right to information and the situation where public administration is not working as it should and does not communicate information. The aim of the paper will be to analyze such a situation and summarize the basic options and procedures, what to do in such a situation, how the citizen can defend himself and what he is entitled to in the proceedings for damages caused by maladministration - by not communicating the required information.
