| Description | In this article I dispute the reasoning of two rulings of Czech Constitutional Court in which it has been stated that an appeal in proceedings under Act No. 82/1998 Coll. is not subject to court fee. I argue that under current state of law there is no justification for exempting this type of remedy from court fees, however, I conclude, on a conciliatory note, that it would be wise to introduce (by an act of the legislature) a lower non-progressive court fee for these cases. |
