Description | This article analyses recent case law of the Court of Justice (CJEU) with a particular interest in various aspects of judicial protection in attempt to determine if there is a way to force the State to fulfil its obligations in environmental protection (judgements in cases C-197/18, Wasserleitungsverband Nördliches Burgenland and Others; C-556/17, Torubarov; C-752/18, Deutsche Umwelthilfe). With the same question, a brief commentary on the groundbreaking decision of the Dutch Supreme Court in the Urgenda case (De Staat der Nederlanden tegen Stichting Urgenda) is provided. The author points to the specific Dutch concept of the ‘duty of care’ which follows the ‘positive action doctrine’ of the European Court of Human Rights (ECtHR). |
