Description Competition law tries to move with the times and to react to the challenges associated with the globalisation and technological development. Therefore, respective competition authorities, incl. the European Commission, are currently targeting the area of on-line sales. The decision-making practice is rather turbulent and has started to develop just recently. In its judgment in Pierre Fabre, the Court of Justice stated that an absolute and general restriction of on-line sales within vertical relationships is deemed hardcorerestriction within the meaning of competition law. The German Federal Court inferred in its judgment in ASICS that restriction of using of price comparison websites could also be deemed hardcore restriction of competition under certain circumstances. This article tries to solve the question whether the ASICS judgment is in principle established by the decision- making practice of the Court of Justice, or whether the conclusions enshrined thereof are applicable in Czechia.
