The autor analyses the current case law of the Supreme Court of the Czech Republic and criticizes it from several viewpoint. His critique focuses especially on the unnecessary formalism to which the current opinion held by the Supreme Court inevitably leads. The author hold an opinion that this consequence violates the case law of the Constitutional Court of the Czech Republic. |
